2degrees Carryover and Unlimited Plans Terms and Conditions - from 6 December 2024

  1. These terms and conditions apply to customers on either a 2degrees Carryover Plan or 2degrees Endless Plan who signed up or have been moved  to an  applicable plan from 8 February 2024 and apply in addition to our Pay Monthly Terms and Conditions and any other specific terms and conditions applying to your Plan or Account with 2degrees. You have accepted these terms and conditions by signing up to your 2degrees Carryover Plan or Unlimited Plan. If you signed up to a 2degrees Carryover or Endless Plan prior to 23 January 2023 and have not been moved to an applicable plan then the 2degrees Carryover and Endless Plans Terms and Conditions – prior to 24 June 2024 apply to you.
  2. In the case of inconsistency with these terms and the Pay Monthly Terms and Conditions, these terms will prevail. Unless stated otherwise, capitalised terms used in these terms and conditions shall have the same meaning given to them in the Pay Monthly Terms and Conditions, provided that reference to:
    1. Unlimited Calls has the meaning given in clauses 21  to 23  of these terms and conditions;
    2. Unlimited Text has the meaning given in clause 24 to 26 of these terms and conditions;
    3. Unlimited NZ Data has the meaning given in clauses 10  to 14 of these terms and conditions; and
    4. Plan Benefit means the minutes, text and data allocation under each Plan as set out in clause 5.
  3. The rates and conditions below apply to you when you use your Mobile Phone (or other device) in New Zealand.
  4. All rates are inclusive of GST.
  5. Subject to these terms and conditions, you may sign up to the following current Plans (see bottom of T&Cs for retired plans):

NZ Carryover Data

  1. NZ Carryover Data is allocated on your Billing Date and can only be used in New Zealand.
  2. If you do not use your full allocation of NZ Carryover Data during your billing month, your unused NZ Carryover Data for that billing month will be carried over to the following billing month. NZ Carryover Data (if not used) can be accrued for up to 12 months and will expire on the day prior to the first anniversary of the Billing Date on which this NZ Carryover Data was first allocated to you. During any billing month, your allocated Plan data will always be used before any NZ Carryover Data you have accrued.
  3. If you consume all the NZ Carryover Data available under your Plan in any billing month you must purchase a Data Add On to continue using data services until a new allocation of NZ Carryover Data is made under your Plan on your next Billing Date. You will be charged for any Data Add On purchased by you in accordance with the terms of that Add On.
  4. Data usage per session is rounded up to the nearest 46.08KB increment. Minimum data usage per session of up to 46.08KB applies.

Unlimited NZ Data

  1. You will be charged a 0 cent per MB rate for all data consumed in New Zealand on each Billing Date for the term of your Plan provided you pay the applicable Plan Charge.
  2. Unlimited NZ Data may be used for hotspotting and standard personal use only. You must not use Unlimited NZ Data for machine-to-machine communications; or in a manner that interferes with our ability to provide quality service to other users; or commercial type activities; or any other similar activity that we consider to be non-standard personal usage (Restricted Activities). If, acting reasonably, we think you’re using our services for Restricted Activities, we may ask you to stop using our services in that manner. If you ignore us or misuse or interfere with the 2degrees Network the Service may be slowed, reprioritised, suspended, terminated, or restricted and your Plan could be suspended or terminated immediately with notice.
  3. Our Fair Use Policy applies to Unlimited NZ Data. Please ensure that you have read and understood this policy (which also forms part of the Pay Monthly Terms and Conditions and is published by us at 2degreesmobile.co.nz/fairusepolicy). We may take action if we consider your use of Unlimited NZ Data breaches the Fair Use Policy.
  4. The actual data speed you achieve when using any data is dependent on a number of factors, including (but not limited to) how far you and your phone are from the nearest cell tower site and congestion on a particular cell tower at any given time.
  5. We reserve the right to monitor data usage and customer volumes, to ensure customers are complying with our terms of use. Service may be slowed, suspended, terminated, or restricted for: misuse, or interference with the 2degrees Network.

Carryover Minutes

  1. Carryover Minutes are only valid for voice calls to any standard landline or mobile in New Zealand and Australia.
  2. Carryover Minutes allocated under a Plan will be pro-rated up to the Billing Date following activation of that Plan, and thereafter will be allocated on each Billing Date.
  3. If you do not use your full allocation of Carryover Minutes during your billing month, your unused Carryover Minutes for that billing month will be carried over to the following Billing month. Carryover Minutes (if not used) can be accrued for up to 12 months and will expire on the day prior to the first anniversary of the Billing Date on which these minutes were first allocated to you. During any billing month, your accrued Carryover Minutes (if any) will always be used before any new allocation of Carryover Minutes for that billing month.
  4. If you consume all of your Carryover Minutes while you are on a call, you will be charged the standard per minute rate for the remainder of the call and for any subsequent calls in accordance with our Pay Monthly Standard Rates Terms and Conditions until you are allocated further Carryover Minutes on your next Billing Date.
  5. Carryover Minutes cannot be used to make calls to premium rate numbers (for example 0900, 018), or satellite phones.
  6. All calls are rounded up to the next whole minute.

Unlimited Calls

  1. You will be charged a 0 cent per minute rate for all calls to any standard mobile or landline in New Zealand and Australia on each Billing Date for the term of your applicable Plan provided you pay the applicable Plan Charge.
  2. Unlimited Calls cannot be used to make calls to premium rate numbers (e.g. 018, 0900) or satellite phones.
  3. Our Fair Use Policy applies to Unlimited Calls. For the avoidance of doubt your use of Unlimited Calls must be person to person use consistent with our estimate of reasonable use of this service (referencing standard and/or estimated customer profiles). We may take action if we consider your use to be in breach of the Fair Use Policy. Please ensure that you have read and understood our Fair Use Policy, which forms part of our standard Pay Monthly Terms and Conditions and is published by us at www.2degreesmobile.co.nz//termsofuse/fair-use-policy/.

Unlimited Text

  1. You will be charged a 0 cent per text rate for all text messages sent to any standard mobile in New Zealand and Australia on each Billing Date for the term of your Plan provided you pay the applicable Plan Charge.
  2. Unlimited Text cannot be used for MMS or texts to premium rate numbers.
  3. Our Fair Use Policy applies to Unlimited Text. For the avoidance of doubt, Unlimited Text is only available for person to person use consistent with our estimate of reasonable use of this service (referencing standard and/or estimated customer profiles). We may take action if we consider your use to be in breach of the Fair Use Policy. Please ensure that you have read and understood our Fair Use Policy, which forms part of the Pay Monthly Terms and Conditions and is published by us at 2degreesmobile.co.nz/termsofuse/fair-use-policy/.

Group Plans

  1. Group Plans are available with our $50 Carryover Plan, $65 Carryover Plan and $80 Unlimited Plan (Primary Plan).
  2. As Account Owner on a Primary Plan you may:
    1. add up to 9 connections on your Account; and
    2. up to 5 of those 9 connections may be Plans that have the same or lessor benefits (as applicable) allocated to each connection as the Primary Plan (each known as a Group Plan).
  3. The following Group Plans are available under each Primary Plan. All Group Plans can only belong to one Primary Plan at any one time:

  1. For each Group Plan that is successfully set up, you will be charged from $30 (incl. GST) each Billing Month.
  2. You must also set up and maintain CCA/DDA on your Account in accordance with our CCA/DDA T&Cs, unless we inform you otherwise.
  3. The mobile number for each Group Plan will be added to your Account. When this occurs, you will be responsible for all Charges for each Group Plan under your Account and procuring each relevant individual’s agreement to our Privacy Policy and other relevant T&Cs. 
  4. As the Primary Plan holder, you will be able to:
    1. access usage details relating to each Group Plan;
    2. change the Primary or Group Plan (e.g., downgrading or upgrading the Plan type, adding call bars to prevent international dialling, or adding or removing other add-ons such as Interest Free Payments);
    3. terminate or suspend the Primary Plan and/or Group Plans; and
    4. move a number to another provider.
  5. If an individual has a Plan and they transfer to a Group Plan, the individual:
    1. is responsible for any outstanding charges that remain on their Account at the time of joining a Group Plan including repayment of any remaining Interest Free payments;
    2. acknowledges that:
      1. if they have any AddOns or discounts on their existing Plan/Account, these won't be applied to the new Group Plan;
      2. any existing balances (including any Carryover balances and /or Prepay credit) will expire immediately; and
      3. the new Group Plan Charges will be pro-rated (in terms of both the monthly Charges of that Plan and the calling, text and data benefits) from the date it is Activated until your next Billing Date.
  6. You will receive one Bill for the total Charges incurred under the Group Account, which shall include those incurred by you on your Primary Plan and each Group Plan included. These Charges may include:
    1. any Charges that you or any connection (including a Group Plan) incurs including any recurring or non-recurring AddOns, roaming and international and premium calls over and above the relevant monthly Plan charges; and
    2. any Interest Free repayments for any phones, accessories or other devices added to your Account including any relating to any handsets used by a connection (including a Group Plan) on your Account.
  7. If you terminate the Primary Plan on your Account, or change that Primary Plan to a Plan which is not an eligible Primary Plan, the following will apply:
    1. any remaining Group Plans will automatically be transferred to the replacing  Primary Plan which will now be the Primary Plan on your Account. You acknowledge that changes to your Group Account may be required where the Group Account is not structured in accordance with clause 28; and
    2. you will continue be liable to pay for any relevant Plan Charges and any other Charges incurred by the new Primary Plan and each remaining Group Plan (where applicable); or
    3. where there is no replacing Primary Plan, a remaining Group Plan will automatically be converted into the Primary Plan (to the extent there is a Group Plan with the same benefits as the terminating Primary Plan, this will be the Group Plan that is upgraded). You will be liable for any outstanding Plan Charges and any other Charges incurred under the Primary Plan prior to termination.
  8. You may remove, or transfer any Group Plan to another Account of yours where you are on a Primary Plan (Secondary Account), subject to the following:
    1. the request for removal/transfer of the Group Plan will be effective on the Billing Date following the date of the request. If a request is made on a Billing Date, then the removal will be effective on the following Billing Date; 
    2. you are liable for all Charges incurred in respect of the removed/transferred Group Plan up to the date that Group Plan is removed from the Group Account or transferred to Secondary Account;
    3. where a Group Plan is removed from the Group Account, all unused Plan Benefits, as well as any other benefits and bonus rewards, including the Free Calling Group benefit, associated with that Plan connection will be lost; and
    4. we may refuse the transfer of a Group Plan to the Secondary Account or another Account (as may be applicable) if there are any outstanding Charges remaining under the Group Account.
  9. You may add up to 1 Interest Free handset per Group Plan.
  10. Use of your Free Calling Group (as defined below) (including by Group Plan connections) is subject to the following:
    1. Zero rated calls can be made between Plan Connections under the same Group Account (Free Calling Group) provided that the Plan Benefit of those Plan Connections includes a voice entitlement (e.g. an allocation of Carryover Minutes). For the avoidance of doubt, a Plan Connection that is a NZ Carryover Data only Plan cannot be part of the Free Calling Group. 
    2. Zero rated calling will not be available to a Plan Connection making calls to, or receiving calls from, another Plan Connection in the Free Calling Group, while that Plan Connection is roaming outside of New Zealand.
    3. We may suspend or bar the Free Calling Group if there are any outstanding Charges or any other overdue payment in respect of the Group Account.
    4. Our Fair Use Policy applies to the Free Calling Group. We may take action if we consider use to be in breach of the Fair Use Policy. Please ensure that you have read and understood our Fair Use Policy, which forms part of the Pay Monthly Terms and Conditions and is published by us at 2degreesmobile.co.nz/fairusepolicy

Shared Data

  1. You can share data from any of our Carryover, Unlimited or Endless Plans.
  2. You can only share up to the limited data balance included in your Carryover or Endless Plan or the sharing data amount included in your Unlimited Plan.
  3. You may share data on your Plan with to up to 5 2degrees numbers (each a Recipient). Each Recipient must be on an active Carryover Pay Monthly Plan or 2degrees Carryover Prepay Plan in order to use data shared with them.
  4. Shared Data is data only. Text, calling and other Plan entitlements are excluded. 

Data Sidekick Plans

  1. Sidekick Plans are available to be added to any of our current Carryover, Unlimited and Group Plans (Boss Plan).
  2. If you on a Boss Plan you may add up to 9 connections to your Account (for example, if you have 5 Group Plans then you may add 4 Sidekick Plans to make up your total of 9 connections).
  3. All Plans must be on the same Account.
  4. Sidekick Plans have no recurring allocations and automatically share data from their Boss Plan and any calls and text use will be charged at the applicable mobile casual rates.
  5. Shared data from the Boss Plan will automatically default to open sharing option (ie not a set allocation of shared data). Standard Shared data terms and conditions apply.
  6. You may add multiple Sidekick Plans to the same Boss Plan.
  7. For each Sidekick Plan that is successfully set up, you, as the Account Owner, will be charged from $5 (incl. GST) each Billing Month.
  8. You may add up to 1 Interest Free device per Sidekick Plan in selected 2degrees sales channels.
  9. You will be responsible for:
    1. any Charges incurred using a Sidekick Plan including roaming and international and premium calls over and above the relevant monthly Plan charges; and
    2. any Interest Free repayments for any device or accessories added to your Account.
  10. If the Boss Plan is terminated any associated Sidekick Plans will also be terminated. Any Sidekick Plans you wish to keep will need to be moved to another Boss Plan on your account before the original Boss Plan is terminated.
  11. You may terminate any Sidekick Plan at any time. You will be liable to pay all Charges outstanding in respect of the Sidekick Plan on termination including your Sidekick Plan Charge for the month up to your next Billing Date and any remaining Interest Free repayments.

Terminating your Freedom Term Plan

  1. You can terminate your Plan at any time prior to your next Billing Date by calling Customer Care.
  2. You will be liable to pay all Charges outstanding in respect of your Plan on termination of that Plan including your Plan Charge for the month up to your next Billing Date.

Changing to another Plan

  1. You are allowed to change your Plan once per billing month to a new available Plan via Customer Care or in store.
  2. We will apply your Plan transfer charge (if applicable) on your next applicable Bill.
  3. In respect of Unlimited Plans, if you end or move from your Unlimited Plan all of you Plan Benefits immediately expire and do not Carryover including if you have moved to another 2degrees Pay Monthly or Prepay Plan or 2degrees Account.
  4. If you move from a Carryover Plan to an Unlimited Plan, any Carryover balance will immediately expire and are not available on your new Unlimited Plan.
  5. We may refuse to transfer you on to a new Plan if you have not paid all of the outstanding Charges relating to your Account with us.

Transferring or switching to another Service or Plan

  1. You may be able to transfer your Plan to another Service or Account made available by 2degrees from time to time, subject to these terms and conditions and any other terms and conditions applicable to those Services, Plans or Accounts.
  2. We may refuse to transfer your Plan if you have not paid all of the outstanding Charges relating to your Plan.
  3. If you transfer your Plan in accordance with these terms you will lose all unused Plan Benefits, any bonus rewards or other benefits associated with your Plan.

Withdrawing the Plan

  1. We reserve the right to remove the Plan from the market (and suggest switching to the best alternative plan) in accordance with our standard T&Cs.

Add Ons

  1. You may purchase Add Ons in conjunction with your Plan in accordance with the specific terms and conditions relating to those Add Ons as published by 2degrees on its website at www.2degreesmobile.co.nz. You will be responsible for any applicable Add On Charges.
  2. Any Add Ons you purchase will commence on the date of purchase. Add On Charges will be included in your next Bill, and subsequent Bills where the Add On is recurring, from commencement until you end the Add On.
  3. No discounts or promotional offers including, but not limited to, association discounts and Friends and Family discounts, can be used with, or applied to, you Plan or Plan Changes.If you terminate your Plan and transfer to a Prepay Account you may lose all unused Add On benefits on transferring to a Prepay Account, and the Add On(s) will stop recurring. You will need to re-purchase the Add On(s) to your Prepay Account to continue to receive those Add On benefits.
  4. If you transfer your Plan to another Plan or Service offered by 2degrees from time to time you may lose all unused Add On benefits and your Add On(s) may terminate on the date of transfer to your new Plan or Service.
  5. If authorised by the Group Account Owner to do so, a Group Plan User can purchase Add Ons in conjunction with the Group Plan they are using in accordance with the specific terms and conditions relating to those Add Ons. You are liable for any applicable Charges incurred under those Add Ons.

General

  1. Unless provided otherwise by the terms of a Plan, all Services are charged at the standard rates set out in our Pay Monthly Standard Rates Terms and Conditions.
  2. Subject to any Add On conditions, the voice, text and data benefits of your Plan that expire first will be used first.
  3. Your Plan Charge and Plan Benefits will be pro-rated from the date of Activation of your Plan until your first Billing Date.
  4. Because we charge for Services after you use them (in arrears) you will receive a final Bill on your final Billing Date covering your final month of Plan Charge and all other Charges incurred up to your final Billing Date.
  5. You will remain liable for all Charges incurred up to the date we end your Account with us.
  6. Plan Benefits cannot be transferred to any other person or to another account you or any other person may have with us.
  7. Our standard overseas roaming rates apply to your Plan, see International Roaming (Pay Monthly/Business).
  8. If we consider you have breached these terms and conditions for any reason or reasonably suspect that you have tampered with, intervened in any unauthorised or fraudulent manner, or any other reason which may interfere or affect the administration, security, fairness, integrity or proper conduct of your Plan, we reserve the right in our sole discretion to take any action available to us, including termination of your plan.
  9. We may withdraw the availability of the Plan to new customers at any time.
  10. We may change the Plan Benefits under any Plan, or these terms and conditions from time to time. Any changes will be notified to you in accordance with our obligations under the Pay Monthly Terms and Conditions.
