Group Account (Free Calling Group) Terms and Conditions

  1. These specific terms and conditions apply in addition to our standard Pay Monthly Terms and Conditions and any other specific terms and conditions applicable to a Plan or Service under your Account (Applicable Terms).
  2. These terms and conditions prevail in the event of inconsistency with the Applicable Terms. Capitalised terms not defined in these terms and conditions have the meaning given to them in the Applicable Terms. For the avoidance of doubt, reference to a Plan in these terms and conditions means any 2degrees Plan that is not a Plan connected under a 2degrees Business Account.
  3. You (the Group Account Owner) may apply for a Group Account which permits you to Activate a maximum of five (5) connections, each to a Plan on a month to month, 12 month or 24 month term (Plan Connections),in accordance with these terms.  
  4. Your eligibility for a Group Account is at the discretion of 2degrees at all times.

Group Account Set Up

  1. To apply for a Group Account you need to: 
    1. complete the Account set-up process, including a credit check in accordance with our Pay Monthly Terms and Conditions, and sign up a maximum of five (5) Plan Connections to be Activated under a Group Account (if you are currently not a 2degrees customer or a 2degrees Prepay customer); or
    2. be connected to an existing Plan at the time of your application for a Group Account and sign up a maximum of four (4) additional Plan Connections under a Group Account.
  1. The Group Account will include all records of the usage under each Plan Connection, payments and outstanding Charges in respect of any Services provided to the Group Account or any Plan Connection belonging to the Group Account.

Group Account Owner

  1. The Group Account Owner is the person who has completed the set up process for a Group Account in accordance with these terms and, unless stated otherwise in these terms, has the authority to activate, remove or change the Plan Connections under the Group Account. 
  2. The Group Account Owner is liable for all Charges incurred under each Plan Connection belonging to the Group Account, including but not limited to any Charges incurred in respect of any Services provided to the Plan Connections (such as Add Ons) or the Group Account, as well as any early termination charges and plan transfer charges that may apply to a specific Plan Connection.
  3. The Group Account Owner will receive one bill for the total Charges incurred under the Group Account by each Plan Connection or other Services provided to the Group Account, each month on the allocated Billing Date for the Group Account. 

Plan Connections

  1. Unless otherwise stated in these terms, only you as the Group Account Owner may add or remove Plan Connections under the Group Account, or change the term or the Plan value of any Plan Connection.
  2. A Plan Connection can belong only to one Group Account at any one time.
  3. If you at any time add a new Plan Connection to the Group Account, we may require you to undergo a further credit check, or we may require a further security deposit or personal guarantee from you and/or impose other conditions in respect of the Group Account. We also may refuse the Activation of a new Plan Connection under the Group Account if you have any outstanding Charges or any other overdue payment in respect of the Group Account or any other Account with 2degrees applicable to you.
  4. The Activation of a Plan Connection under the Group Account is at the discretion of 2degrees.
  5. A Plan Connection may be added to a Group Account as one of the following:
    1. a new Plan signed up by the Group Account Owner as a Plan Connection; or
    2. a 2degrees Prepay connection that is transferred to the Group Account by Activating it as a Plan Connection; or  
    3. an existing Plan belonging to another 2degrees customer that is transferred into the Group Account as a Plan Connection (a Transferred Plan Connection).
  6. If you are activating a Transferred Plan Connection under a Group Account, then the following conditions apply:    
    1. The transfer of the Transferred Plan Connection to the Group Account is subject to any specific Plan terms and conditions applying to the Transferred Plan Connection.  
    2. Once the Transferred Plan Connection is Activated under the Group Account you can change the Transferred Plan Connection to a Plan of a higher or lower value, however you as the Group Account Owner, will be liable for any applicable Plan transfer charges.
    3. You cannot change the fixed term of the Transferred Plan Connection prior to its Activation under the Group Account. The existing term of the Transferred Plan Connection will continue to apply once it is Activated under the Group Account. If you wish to change the term of the Transferred Plan Connection once it is Activated under the Group Account, then you as the Group Account Owner will be liable for any early termination charges that may be applicable to that Transferred Plan Connection.
    4. The Transferred Plan Connection will be pro-rated (in terms of both the monthly charge of that Plan and the calling, text and data benefits) from the date it is Activated under the Group Account until the Group Account’s next Billing Date.
    5. The accrued entitlements and other benefits of the Transferred Plan Connection applicable prior to the date of its transfer to the Group Account, including but not limited to any remaining credit balance, Plan discount, Carryover Minutes, Carryover Data, Association Benefit, Bonus Minutes and Bonus Data, will not be transferred to the Group Account and will be lost.
    6. From the date the Transferred Plan Connection is Activated under the Group Account, you as the Group Account Owner assume all liabilities with respect to that Transferred Plan Connection, including any additional Services that may be added to that Transferred Plan Connection (such as Add Ons), and the Charges generated under the Transferred Plan Connection. 
  7. If a 2degrees Prepay connection is transferred to the Group Account as a Plan Connection then any Re-charge Credit remaining on that Prepay Account will also be transferred to the Group Account and be allocated as credit on the Group Account’s next Bill.
  8. Any Plan entitlements or other Services specific to a particular Plan Connection cannot be shared with the other Plan Connections under the Group Account. In addition, any Plan discount, Association Benefits, Bonus Minutes, Bonus Data or other benefits specific to a particular Plan Connection will not automatically apply to the other Plan Connections under the Group Account.

End Users of a Plan Connection

  1. The Plan Connections under the Group Account may have End Users that are not the Group Account Owner.
  2. The Group Account Owner can authorise End User(s) to add or remove certain Services (including Add Ons) to a Plan Connection under the Group Account which they are using. End Users who are not the Group Account Owner may not add Plan Connections to the Group Account, transfer Plan Connections to a different Group Account, or change the term or the Plan value of a particular Plan Connection. An End User will be able to port out their Plan Connection to another network without the Group Account Owner’s consent, and this will be deemed a termination of that Plan Connection under the Group Account.  
  3. The Group Account Owner is deemed to have authorised any action of an End User in respect of a Plan Connection or other Services under the Group Account, and is liable for any acts or omissions of the End User in respect of the Group Account, including any Charges incurred by the End User (which may include early termination charges).

Free calling group

  1. Zero rated calls can be made between Plan Connections under the same Group Account (Free Calling Group) provided that the Plan Benefit of those Plan Connections includes a voice entitlement (e.g. an allocation of Carryover Minutes). For the avoidance of doubt, a Plan Connection that is a NZ Carryover Data Plan cannot be part of the Free Calling Group. 
  2. Zero rated calling will not be available to a Plan Connection making calls to, or receiving calls from, another Plan Connection in the Free Calling Group, while that Plan Connection is roaming outside of New Zealand.
  3. We may suspend or bar the Free Calling Group if there are any outstanding Charges or any other overdue payment in respect of the Group Account.
  4. Our Fair Use Policy applies to the Free Calling Group. We may take action if we consider use to be in breach of the Fair Use Policy. Please ensure that you have read and understood our Fair Use Policy, which forms part of the Pay Monthly Terms and Conditions and is published by us at 2degreesmobile.co.nz/fairusepolicy

Billing Date   

  1. We will allocate a Billing Date upon Activation of the Group Account.  The Group Account Owner will be billed monthly in arrears on each Billing Date for all Charges incurred under the Group Account.    
  2. One Bill will be received in respect of all of the Plan Connections under the Group Account in accordance with the Pay Monthly Terms and Conditions.
  3. The Charges incurred under each Plan Connection or Service made available under the Group Account will be pro-rated from the date the applicable Plan Connection or Service is Activated under the Group Account up to the Billing Date. 

Credit Limit

  1. We may set or change the credit limit applicable to the Group Account and may suspend the Group Account or any particular Plan Connection if that limit is exceeded.

Plan benefits

  1. We may change the Plan Benefits you receive for any Plan Connection under the Group Account, as well as any other Services, bonus rewards or other benefits associated with your Plan Connections or the Group Account, at any time at our discretion. We will notify you of those changes in accordance with our standard Pay Monthly Terms and Conditions

Termination of Plan Connections

  1. The Group Account Owner may request that a Plan Connection be removed from the Group Account at any time. 
  2. A Plan Connection can be removed from the Group Account either by terminating the Plan Connection or transferring the Plan Connection to another Group Account. If you or an End User changes the term of a Plan Connection or changes the Plan value of the Plan Connection prior to its transfer to another Group Account then you will be liable for any applicable early termination charges or plan transfer charges respectively. We may refuse the transfer of a Plan Connection to another Group Account or other Account (as may be applicable) if there are any outstanding Charges remaining under the Group Account.  
  3. We may refuse the transfer of a Plan Connection to another Group Account or other Account (as may be applicable) if there are any outstanding Charges remaining under the Group Account. The Group Account Owner is liable to pay all Charges incurred in respect of the removed Plan Connection up to the date that Plan Connection is removed from the Group Account.   
  4. The request for removal of a Plan Connection will be effective on the Billing Date following the date of the request. If a request is made on a Billing Date, then the removal will be effective on the following Billing Date. 
  5. The Group Account Owner is liable to pay all Charges incurred in respect of the removed Plan Connection up to the date that Plan Connection is removed from the Group Account.   
  6. The removal of a Plan Connection from the Group Account will not affect the remaining Plan Connections under the Group Account. 
  7. If the Group Account Owner terminates or removes their own Plan Connection from the Group Account, the remaining Plan Connection(s) will continue to remain active and the Group Account Owner will be liable for all Charges incurred under the active Plan Connections. 
  8. Where a fixed term Plan Connection (e.g. a 12 month or 24 month term) is terminated by the Group Account Owner in accordance with these terms prior to the expiry of its fixed term, the Group Account Owner will be liable for the early termination charges applicable to that Plan Connection. The early termination charges applicable to the Plans can be viewed on our website at www.2degreesmobile.co.nz.  
  9. We may terminate any Plan Connection under the Group Account or the Group Account at any time in accordance with our standard Pay Monthly Terms and Conditions, and if we do, the Group Account Owner may be liable to pay any applicable early termination charges if the termination is of a fixed term Plan Connection(s) prior to the expiry of its fixed term. 
  10. We will waive applicable early termination charges where there is a re-sign of a Plan Connection under the Group Account to a new 12 or 24 month term in the following periods: 
    1. If the Plan Connection is on a 12 month term, that Plan Connection can be resigned to a new term anytime within 60 days prior to the expiry of the 12 month term; and
    2. If the Plan Connection is on a 24 month term, that Plan Connection can be resigned to a new term anytime within 90 days prior to the expiry of the 24 month term.
  11. Once a Plan Connection is removed from the Group Account, all unused Plan Benefits, as well as any other benefits and bonus rewards, including the Free Calling Group benefit, associated with that Plan Connection will be lost. 

Terminating the Group Account 

  1. The Account Owner can request that the Group Account be terminated at any time. This will result in all active Plan Connections under the Group Account being terminated. The Group Account Owner may be liable to pay early termination charges where any fixed term Plan Connection is terminated as a result of the termination fo the Group Account. The early termination charges applicable to the Plans can be viewed on our website at www.2degreesmobile.co.nz.   
  2. The request for termination of the Group Account will be effective on the Billing Date following the date of the request. If a request is made on a Billing Date, then the removal will be effective on the following Billing Date.

Add Ons

  1. If authorised by the Group Account Owner to do so, an End User can purchase Add Ons in conjunction with the Plan Connection they are using in accordance with the specific terms and conditions relating to those Add Ons. The Group Account Owner is liable for any applicable Charges incurred under those Add Ons.
  2. Charges incurred under an Add On will be shown on the Group Account’s Bill, and subsequent Bills where the Add On is recurring.

General

  1. Plan Connections are subject to any specific terms and conditions that relate to our Plans as shown on our website. 
  2. Unless provided otherwise, all Services are charged at the standard rates set out on our website, 2degreesmobile.co.nz.
  3. Each Plan Connection’s oldest voice, text and data benefits (whether Plan Benefits or Add On benefits) will be used first.
  4. Because we charge for Services after you use them (in arrears) a final Bill covering the final months Charges incurred will be received on the Group Account’s final Billing Date.  
  5. Plan Benefits cannot be transferred to any other person, Plan, Service or to another Account that you (or any other person) may have with us. 
  6. We may change these terms and conditions from time to time. Any changes will be notified to you in accordance with our obligations under the Pay Monthly Terms and Conditions.
