Retired Business Connect Terms and Conditions - 20 September 2017
- These specific terms and conditions apply to you if you have signed up to a Business Connect Plan prior to 20 September 2017. These terms and conditions apply in addition to our standard Business Terms and Conditions and the Business Account Terms and Conditions and will prevail in the event of any inconsistency between these terms and conditions and the Business Terms and Conditions or the Business Account Terms and Conditions.
- Capitalised terms not defined herein have the meaning given to them in the Business Terms and Conditions and the Business Account Terms and Conditions.
- The rates and conditions below apply when you use your Mobile Phone (or other device) in New Zealand only and have subscribed to a Business Connect Plan.
Business Connect Plan
- You can sign up to either:
(a) the 12GB Business Connect Plan and receive 12GB NZ Carryover Data per month (subject to a 200GB cap); or
(b) the 50GB Business Connect Plan and receive 50GB NZ Carryover Data per month (subject to a 200GB cap).
- Under your Business Connect Plan you must have at least one Talk & Text Connection or Data Connection (each a Connection). A Team Member can be connected to a Connection belonging to your Business Connect Plan. You can have a maximum of 200 connections under your Business Connect Plan.
- Each Connection set up under the Business Connect Plan will share the pool of NZ Carryover Data (and otherwise any NZ Data automatically added) that is available under the Business Connect Plan. All data under your Business Connect Plan is used on a first in first served basis. No limit applies to an individual Connection’s use of data, and no Connection will be given priority over another Connection in respect of the use of available data.
- Your Business Connect Plan you will also receive automatic allocations of 10GB of NZ Data when the total available data under your Business Connect Plan is almost out in accordance with clause 14 below.
- You will be charged each month for your Plan, each Connection and any automatic allocation of NZ Data to your Plan in accordance with your sign-up forms for your Business Connect Plan.
Data allocations
- NZ Carryover Data can only be used in New Zealand.
- You will receive the full allocation of NZ Carryover Data on activation of your Business Connect Plan, and you will be charged the full charge for your Plan on your first Billing Date. Further allocations of NZ Carryover Data will occur on each Billing Date for the duration of your Plan (subject to the 200GB cap described below).
- If the full allocation of NZ Carryover Data under the Business Connect Plan is not used during a Billing month, that data will be carried over to the following Billing month provided you have not reached the 200GB cap applicable to your Plan. NZ Carryover Data may be accrued for up to 12 months.
- The NZ Carryover Data available under your Business Connect Plan cannot exceed 200GB on any Billing Date. Your new NZ Carryover Data allocation on any Billing Date will be adjusted to ensure that the 200GB cap is not exceeded. For example, if on a Billing Date the total NZ Carryover Data that you have accrued from the following months is 80GB, your new NZ Carryover Data allocation on that Billing Date will be 20GB. Similarly, if the total NZ Carryover Data you have accrued from the following months is 200GB on a particular Billing Date, then no new NZ Carryover Data will be allocated to the Plan on that Billing Date (but you will continue to be charged your monthly Business Connect Plan fee as per clause 4 above).
- Each time a Connection begins a data session, 10MB of the total available data under your Business Connect Plan will be reserved by that Connection. If the Connection uses less than 10MB during that data session, then the remaining data will returned to the total available data under the Business Connect Plan.
- An additional 10GB of NZ Data will automatically be added to your Business Connect Plan when the data remaining under your Business Connect Plan (excluding data that has been reserved as described in clause 13 above) is 500MB.
- Each 10GB NZ Data bundle will expire 30 days from date of its allocation. NZ Data can only be used in New Zealand.
- The data benefits of the Business Connect Plan that are due to expire first will be used first.
- Data usage per session is rounded up to the nearest 5.12KB increment. Minimum data usage per session of 20.48KB applies.
Talk & Text Connection
- A Talk & Text Connection can be either a:
(a) Talk & Text Connect 24 month term connection; or
(b) Talk & Text Connect Flexi 0 term connection.
- You will be charged for each Talk & Text Connection added to your Business Connect Plan in accordance with your sign-up forms for your Business Connect Plan.
- Each Talk & Text Connection includes unlimited calling and texting to New Zealand and Australia (subject to our Fair Use Policy, see clause 27).
Unlimited Calling to New Zealand and Australia
- Minutes are only valid for voice calls to any standard landline or mobile in New Zealand and Australia.
- Calls are charged at a 0 cents per minute rate on each Billing Date for the term of the applicable Talk & Text Connection.
- Unlimited Calls cannot be used to make calls to premium rate numbers (e.g. 018, 0900) or satellite phones. Calls to voicemail are included.
Unlimited Text to New Zealand and Australia
- Texts are only valid to any standard mobile in New Zealand and Australia
- Texts will be charged at a 0 cent per text rate on each Billing Date for the term of the applicable Talk & Text Connection.
- Unlimited Text cannot be used for MMS or texts to premium rate numbers.
Fair Use Policy
- Our Fair Use Policy applies to unlimited calling and texting to New Zealand and Australia. For the avoidance of doubt, unlimited calls and texts must be person to person use consistent with our estimate of reasonable use of this service (referencing standard and/or estimated customer profiles). We may take action if we consider the use to be in breach of the Fair Use Policy. Please ensure that you have read and understood our Fair Use Policy, which forms part of the Business Terms and Conditions and is published by us at 2degreesmobile.co.nz/fairusepolicy.
Data Connection
- A Data Connection can be either a:
(a) Data Connect 24 month term connection; or
(b) Data Connect Flexi 0 term connection.
- You will be charged for each Data Connection added to your Business Connect Plan in accordance with your sign-up forms for your Business Connect Plan.
- Each Data Connection does not include any minutes or text entitlements and can only share the pool of data allocated under the Business Connect Plan. You will be charged at our Business standard rates for calling and texting (as published on our website at 2degreesmobile.co.nz).
International Calling and Roaming
- You will be charged our standard rates for international calling and international roaming made by any Connection under your Business Connect Plan. You will find our standard rates published on our website at 2degreesmobile.co.nz
Free Calling Group
- Zero rated voice calls can be made between Team Members connected to Talk & Text Connection, as well as any other Team Member connected to a Plan under the same Business Account, (Free Calling Group) provided that Plan includes a voice entitlement (eg. Carryover Minute entitlement). Free Calling Group is applied at a Business Account level only. Video calling is not included in the Free Calling Group.
- For the avoidance of doubt, a Team Member connected to a Data Connection or a Business Mobile Data Plan cannot be part of the Free Calling Group.
- Zero rated calling will not be available to a Team Member making calls to, or receiving calls from, another Team Member in the Free Calling Group, while that Team Member is roaming outside of New Zealand.
- We may suspend or bar your Free Calling Group if you have any outstanding Charges or any other overdue payment in respect of your Business Account.
- Our Fair Use Policy applies the Free Calling Group. We may take action if we consider use to be in breach of the Fair Use Policy. Please ensure that you have read and understood our Fair Use Policy, which forms part of the Business Terms and Conditions and is published by us at 2degreesmobile.co.nz/fairusepolicy.
Business Bonus
- The Business Bonus is a discount on the price of a handset or other mobile device which is received on the successful activation of a 24 month term Talk & Text Connection or Data Connection and can be redeemed at the time of sale.
- The Business Bonus is not available to a Connection on a 0 month term, or to any Team Member who is transferring their existing fixed term Plan or Service to a 24 month term Connection.
- The amount of the Business Bonus available under a 24 month term Connection is at all times subject to 2degrees’ discretion.
- The Business Bonus is not available in conjunction with any other mobile subsidy offered.
Changing your Business Connect Plan, Talk & Text Connection or Data Connection
- You can change your Business Connect Plan to another available Business Connect Plan at any time. However, unless stated otherwise you cannot change your Business Connect Plan to any other Plan or service offered by 2degrees. If you do so, your Business Connect Plan will be terminated when you no longer have any Talk & Text Connections or Data Connections connected to the Business Connect
- Subject to clause 46, a Connection can be changed to another type of Connection or Plan or Service offered by 2degrees (New Plan) and available under the same Business Account.
- Changing a Connection to a New Plan will not entitle you to a new Business Bonus, if a Business Bonus had already been received with the activation of the original Connection.
- We may refuse to change a Connection to a New Plan if you have not paid all of the outstanding Charges under your Business Account.
- If your Connection is on a 24 month term, you will not be able to change to another Connection or another Plan or Service made available by 2degrees unless you first pay an early termination charge in accordance with clause 50 below.

Termination of a Talk & Text Connection or Data Connection
- You may request the termination of a Connection under your Business Account at any time.
- You will be liable to us for all Charges (including any applicable early termination charges) in respect of the Connection you are terminating up to the date of termination.
- You may be required to pay us an early termination charge where you terminate a Connection on a 24 month term prior to the expiry of that fixed term.
- The amount of the early termination charge applicable to the termination of a Connection will be calculated as follows:

(a) 24 month term Talk & Text Connection
For Connections signed up before 13 January 2016:
The monthly charge (including GST) multiplied by the number of months remaining as at the final Billing Date for that Connection multiplied by 50%, subject to a minimum payment amount of $180 (i.e. if the amount calculated is less than the minimum amount of $180, you will need to pay the minimum amount)
For Connections signed up on or after 13 January 2016:
The monthly charge (including GST) multiplied by the number of months remaining as at the final Billing Date for that Connection multiplied by 65%, subject to a minimum payment amount of $180 (i.e. if the amount calculated is less than the minimum amount of $180, you will need to pay the minimum amount)
(b) 24 month term Data Connection
The monthly charge (including GST) multiplied by the number of months remaining as at the final Billing Date for that Connection multiplied by 50%, subject to a minimum payment amount of $20 (i.e. if the amount calculated is less than the minimum amount of $20, you will need to pay the minimum amount).
- We will waive applicable early termination charges where you re-sign a 24 month term Connection within 90 days prior to the expiry of its 24 month term.
- Termination of a Connection will result in the loss of all unused entitlements under those connections, including any bonus rewards.
Termination of your Business Connect Plan
- If you request termination of your Business Connect Plan, all active Talk & Text Connections and/or Data Connections will be terminated, and you may be required to pay us early termination charges in accordance clause 50.
- You must pay us all Charges incurred under your Business Connect Plan up to the date your Business Connect Plan is terminated.
Add Ons and other Services
- Add Ons that include any NZ Data entitlements cannot be purchased on any Connection.
- Add Ons that include any minutes to New Zealand and Australia entitlements cannot be purchased on any Connection.
- You will be liable for any charges incurred for any Add Ons purchased under any Connection.
- You will not be able to apply our Shared Data services or Share Everything services to any Connection.
