Retired Business Mobile Data Plans (3 April 2014) Terms and Conditions
These terms and conditions apply to the following Business Mobile Data Plans activated under your Business Account on a 12 month term prior to 3 April 2014:

* The 100MB NZ Data Plan does not include Carryover Data.
- These terms and conditions apply in addition to our Pay Monthly Terms and Conditions and the Business Account Terms and Conditions. If there is any inconsistency between these Business Mobile Data Plan Terms and Conditions, the Pay Monthly Terms and Conditions, or the Business Account Terms and Conditions, these Business Mobile Data Plan Terms and Conditions will prevail.
- Unless stated otherwise, capitalised terms used in these Business Mobile Data Plan Terms and Conditions shall have the meaning given to them in the Pay Monthly Terms and Conditions and the Business Account Terms and Conditions, and reference to:
“Business Mobile Data Plan” means a Plan described in clause 1 of these Business Mobile Data Plan Terms and Conditions.
- The rates and conditions below apply when you use your Mobile Phone (or other device) in New Zealand only and have subscribed to a Business Mobile Data Plan.
- Unless otherwise stated, all rates are inclusive of GST.
NZ Data
- NZ Data is allocated on your Billing Date and can only be used in New Zealand.
- The NZ Data allocation under a Business Mobile Data Plan will be pro-rated up to the Billing Date following activation of that Business Mobile Data Plan, and thereafter will be allocated on each Billing Date.
- If a Team Member is signed up to the 100MB NZ Data Plan, the NZ Data under that Plan is valid for one month, expiring on your next Billing Date.
- If a Team Member is signed up to a 1GB or 3GBNZ Carryover Data Plan and does not use their full allocation of NZ Data during your Billing month, the unused NZ Data for that Billing month will be carried over to the following Billing month. For the purposes of these terms and conditions, this carry over NZ Data is referred to as “Carryover Data”. Carryover Data (if not used) can be accrued for up to 12 months and will expire on the day prior to the first anniversary of the Billing Date on which this NZ Data was first allocated to you. During any Billing month, your Carryover Data (if any) will always be used before the NZ Data allocation for that Billing month.
- If a Team Members consumes all the NZ Data available under their Business Mobile Data Plan in any Billing month they will be required to purchase a Data Value Pack to be able to continue using data services until a new allocation of NZ Data is made under their Business Mobile Data Plan on your next Billing Date. You will be charged for any Data Value Pack purchased by a Team Member under their applicable Plan.
- Data usage per session is rounded up to the nearest 5.12KB increment. Minimum data usage per session of 20.48KB applies for the 100MB Business Mobile Data Plan, and 51.2KB applies for the 1GB and 3GB Business NZ Carryover Data Plans.
Business Bonus
- The Business Bonus is only available where a Team Member signs up on a 24 month Business Mobile Data Plan. The Business Bonus is not available in respect of month to month or 12 month Business Mobile Data Plans or for Team Members who are transferring their existing Plan or Service to a Business Mobile Data Plan (where applicable).
- The value of the Business Bonus for each 24 month Business Mobile Data Plan is stated in the table above in clause 5 of these terms and conditions. You will be entitled to the Business Bonus on successful activation of the applicable Business Mobile Data Plan.
- The Business Bonus can be redeemed as a discount on the price of a device at a 2degrees store or retailer at the time you sign up to a 24 month Business Mobile Data Plan.
- If the value of your applicable Business Bonus is greater than the price of your chosen device, or you choose not to purchase a device, then you may request a store voucher for the amount of your remaining Business Bonus entitlement.
- The store voucher is redeemable on any items offered for sale in the store at which you signed up to the Business Mobile Data Plan, provided that vouchers will be subject to the terms and conditions applied in that store. Refer to the store voucher or contact the store for further information.
- The Business Bonus is not available in conjunction with any other handset/device subsidy offered.
Early termination of your 12 or 24 month Business Mobile Data Plan
- Subject to clause 22 below, you will be required to pay early termination charges if you terminate a Team Member’s fixed term Business Mobile Data Plan prior to the expiry of its term.
- You will also be charged early termination charges where you wish to change the fixed term of a Team Member’s Business Mobile Data Plan outside of the re-sign periods specified in clause 22 below.
- You may also be required to pay early termination charges where we terminate one of your Team Members’ fixed term Business Mobile Data Plans in accordance with our standard Pay Monthly Terms and Conditions.
- The amount of any early termination charge that you will be required to pay in accordance with these terms and conditions will be published by us on our website from time to time. See our Business Plan ETCs and PTCs Terms and Conditions for more information.
- If a Team Member signs up to a new available fixed term Business Mobile Data Plan prior to the expiry of the existing term of their Business Mobile Data Plan, we will waive any early termination charges only if they re-sign during the following periods:
- If they are on a 12 month Business Mobile Data Plan and they re-sign to a new term anytime within 60 days prior to the expiry of their 12 month term; and
- If they are on a 24 month Business Mobile Data Plan and they re-sign to a new term anytime within 90 days prior to the expiry of their 24 month term.
- The termination of a Team Member’s Business Mobile Data Plan will be effective on your next Billing Date. If the request for the termination is made on your Billing Date, the Team Member’s Business Mobile Data Plan will terminate on your following Billing Date. Your next Bill following that termination will show, in respect of that terminated Plan, the final month’s Plan Charge, any other Charges incurred up to your next Billing Date, and any applicable early termination charges, and you are liable to pay those amounts to 2degrees.
Terminating a Team Member’s month to month Business Mobile Data Plan
- You can terminate a Team Member’s month to month Business Mobile Data Plan at any time prior to your next Billing Date by calling Customer Care on 200.
- The termination of a month to month Business Mobile Data Plan will be effective on your next Billing Date. If the request for the termination is made on your Billing Date, the Team Member’s Business Mobile Data Plan will terminate on your following Billing Date. Your next Bill following that termination will show, in respect of that terminated Plan, the final month’s Plan Charge and any other Charges incurred up to your next Billing Date, and you are liable to pay those amounts to 2degrees.
Changing a Team Member’s Business Mobile Data Plan
- You can change a Team Member’s Business Mobile Data Plan to another Business Mobile Data Plan under your Business Account at any time by calling Customer Care. You cannot change a Team Member’s Business Mobile Data Plan to a Business Carryover Plan or a Business Share Everything Plan.
- If you change a Team Member’s 12 month or 24 month Business Mobile Data Plan to another Business Mobile Data Plan of a lesser Plan Charge you will be required to pay a Plan transfer charge.
- The amount of any Plan transfer charge that you will be required to pay in accordance with these terms and conditions will be published by us on our website from time to time. See our Business Plan ETCs and PTCs Terms and Conditions for more information.
- If you transfer a Team Member’s Business Mobile Data Plan to another Business Mobile Data Plan you will not be entitled to a new Business Bonus.
- The transfer of a Team Member’s Business Mobile Data Plan will be effective on your next Billing Date. Your Bill will be adjusted to the new Business Mobile Data Plan benefits from that Billing Date. We will apply your Plan transfer charge on that Bill.
- We may refuse to change a Team Member’s Business Mobile Data Plan to another Business Mobile Data Plan if you have not paid all of the outstanding Charges under your Business Account.
