Retired NZ Carryover Data Plans (16 February 2015) ETCs Terms and Conditions
These charges apply to you if you signed up to a NZ Carryover Data Plan on a 24 month term only (Retired NZ Carryover Data Plan) prior to 16 February 2015.
- These specific terms and conditions apply in addition to the Pay Monthly Terms & Conditions, and any other specific terms and conditions that apply to a Plan under your Account (together, the Applicable Terms and Conditions).
- These specific terms and conditions will prevail in the case of inconsistency with the Applicable Terms and Conditions.
- Unless stated otherwise, words and phrases in these specific terms and conditions have the same meaning given to them in the Applicable Terms and Conditions.
- Early termination charges are not subject to GST.
Early termination charges
- Unless stated otherwise, we will require you to pay early termination charges where your fixed term Retired NZ Carryover Data Plan is terminated either by you or us in accordance with the Applicable Terms and Conditions.
Retired NZ Carryover Data Plans activated on or after 21 May 2014
- If you activated your Retired NZ Carryover Data Plan on or after 21 May 2014 but prior to 16 February 2015 then these early termination charges apply to you.
- Unless stated otherwise, we will require you to pay early termination charges where your 24 month Retired NZ Carryover Data Plan is terminated either by you or us in accordance with the Applicable Terms and Conditions.
- The amount of the early termination charge that you will be required to pay in respect of your terminated Retired NZ Carryover Data Plan is calculated as follows:
The monthly Plan Charge of your NZ Carryover Data Plan multiplied by the number of months remaining on the term of your NZ Carryover Data Plan as at your final Billing Date multiplied by 40%, provided that if this amount is less than the minimum amount stated in the table below you will be required to pay the minimum amount.

For example, if you terminate your $20.95 1GB NZ Carryover Data Plan in the third month of a 24 month term, your early termination charge will be $175.98 (being $20.95 x 21 x 0.4).
However, if you terminate your $20.95 1GB NZ Carryover Data Plan with five months remaining on your 24 month term, your early termination charge will be $50, being the early termination charge minimum amount stated in the table above (due to $20.95 X 5 X 0.4 = $41.90 being lower than the minimum amount stated).
- For the avoidance of doubt, no early termination charge applies to the termination of a Freedom Term (or month to month) NZ Carryover Data Plan or a NZ Carryover Data Plan on a 12 month term prior to the expiry of its fixed term.
NZ Carryover Data Plans activated prior to 21 May 2014
- If you activated your Retired NZ Carryover Data Plan prior to 21 May 2014 these early termination charges apply to you.
- The amount of the early termination charge that you will be required to pay in respect of your terminated 24 month Retired NZ Carryover Data Plan is calculated as follows:

- Unless stated otherwise, no early termination charge is applicable to the termination of a Freedom Term (or month to month) NZ Carryover Data Plan.
Plan transfer of your retired NZ carryover data plan
- You cannot transfer your Retired NZ Carryover Data Plan to any other Retired Plan or any other Plan or Service offered by 2degrees.
- If you wish to move to another Plan or Service offered by 2degrees, including a Freedom Term NZ Carryover Data Plan, you must first terminate your Retired NZ Carryover Data Plan and pay any early termination charges in accordance with these terms and conditions.
